HRC: Roy Cooper Makes the Right Call, Refuses to Defend Attack on Transgender North Carolinians

Today, HRC praised North Carolina Attorney General Roy Cooper for refusing to defend HB 2 and rightly noting that the bill is unconstitutional. Gov. McCrory’s appalling new law eliminates existing municipal non-discrimination protections for LGBT people and some veterans; prevents such provisions from being passed by cities in the future; and forces transgender students in public schools, as well as adults in state buildings, including public universities, to use restrooms and other facilities inconsistent with their gender identity.

"Attorney General Cooper has made the right call for a very simple reason. He has a responsibility to protect and defend the United States Constitution and this bill, signed into law under the cover of darkness by Gov. McCrory, is blatantly unconstitutional under existing precedent,” said HRC Legal Director Sarah Warbelow. “Gov. McCrory and the North Carolina General Assembly need to immediately repeal the discriminatory provisions of this bill."

While Gov. McCrory hasn't been able to name a single leading business that supports this despicable new law, we've seen a wave of opposition from leading corporations, including from DowBiogenPayPalRedHat, the NCAAAmerican AirlinesSalesforceIBM, Apple, the NBAGoogleMicrosoft,MarriottBayer, and others. The message couldn't be clearer: discrimination is bad for business, and corporate America sees Gov. McCrory’s failed leadership as taking North Carolina in the wrong direction.
