DOJ Answers Complaint; Recognizes Sexual Orientation Discrimination Under Federal Law

Yesterday, the Department of Justice (DOJ) answered a complaint regarding sexual orientation discrimination under existing civil rights law. By not dismissing the case, the DOJ recognized that sexual orientation discrimination is sex discrimination under Title VII.

The plaintiff in the case, David Baldwin, a formal federal worker, filed the case in federal court last year. He claimed that he was discriminated against because of his sexual orientation while working for the Federal Aviation Administration in Miami.

Last year, the EEOC determined in Baldwin v. Foxx that workers are protected under Title VII from employment discrimination based on sexual orientation. 

According to Buzzfeed, this is one of the first signals from the Obama Administration that it would “join the EEOC in advancing the argument that sexual orientation discrimination should be barred under existing law.”
