YouTube personality Calum McSwiggan has been summoned to a Los Angeles court for allegedly filing a false police report, a crime that could land him up to a year in jail time.

McSwiggan was supposed to appear in the Los Angeles International Airport Courthouse on July 19th for his preliminary hearing, but couldn’t attend because of a family holiday in Spain — which we didn’t realize you were allowed to do.

In fact, he’s boldly — perhaps even inadvisedly — posted some vacation pics to Facebook and Instagram:

I know there’s a Bulbasaur around here somewhere ???

Last month, McSwiggan took to Facebook to share a photo of himself in the hospital, describing a brutal attack in West Hollywood on Pride weekend.

But the West Hollywood Sheriff’s deputies charged McSwiggan with vandalizing a car in the 8900 block of Santa Monica Boulevard, who strongly disputed his claim:

Mr. McSwiggan was then observed injuring himself with the handle and receiver to a payphone inside the cell.  Medical personnel were summoned and Mr. McSwiggan was transported to a local hospital for treatment.  Mr. McSwiggan’s booking photo was taken prior to deputies seeing Mr. McSwiggan injuring himself.”

McCallum later admitted to busting his own face, claiming, “I knew I had to injure myself to get out of the cell and into a hospital, and it was the only solution I could find to get myself out of there. This is incredibly out of character for me…”

Right now, he still claims he was attacked by three men that night, and previously pleaded not guilty to the charges.
